Fact: States prosecution witnesses all testified in open court to having seen three (3) male Mexicans commit a drive-by gangland shooting against two (2) rival gang members Danny Hurtado and Amondo Ortiz. October 5, 1990 Hurtado died. Ortiz escaped unharmed.

Fact: Victim Ortiz testified in open court Colin Anditon was not in the car, he was not with the three (3) male Mexicans in the car that day who shot at him and killed his friend Hurtado.

Fact: The Pomona Police Department failed to have a composite photo drawn up. The eye witness was asked repeatedly if she saw them again would she recognize them. She replied yes. No line up was ever done.

Fact: Prosecution witness identified three (3) male Mexicans exiting the car outside her house ten minutes after the shooting had taken place (5PM the evening of October 5th 1990). A light enough evening to see that Colin Anditon was not one of them. Even after being shown mug shots one of them being Colin Anditon (photo #5) she still insisted it was three (3) male Mexicans. She gave a detailed description and even pointed out photo #1 as being the person getting out of the drivers side of the car. This person was Larry Cabrera a known gang member.

Fact: In 1993 that same prosecution witness testified in open court in front of Colin Anditon. That none of the persons exiting the "drive by" car were in that court room. She was asked if it was Colin Anditon, she said no.

Fact: Colin Anditon did steal the car used in the drive by. Oct. 4th 1990.

Fact: Colin was acquainted with Cabrera through his younger brother who attended the same school as Cabrera.

Fact: Colin Anditons finger prints were on that car from earlier in the day.

Fact: Cabrera took the stolen car from the driveway of a house Colin was visiting.

Fact: Cabrera returned to the house after having committed the drive by shooting boasting of just smoking some fool of the 12th street gang and had dumped the car outside prosecution witnesses house on Elwood.

Fact: Prosecution witness stated all three (3) exiting the car wore gloves.

Fact: While in jail on unrelated charges of car theft, Colin Anditon bragged to a fellow inmate Michael Standon ( a convicted criminal who had been wired and placed in the cell for three days with Colin. Colin Anditon bragged to Michael Standon that he’d committed many crimes. He fantasized he had done the drive by shooting he fantasized he had a villa in Mexico he bragged he had killed two (2) other people. He had bragged he had stolen cars and leather jackets. For all of this bragging Colin Anditon spoke the truth when he said he had stolen cars and leather jackets. Colin Anditon was a self-confessed car thief. But that did not make him a murderer. The prosecution sifted through the truth and fantasy and the truth and decided the theft of cars and leather jackets was true. The drive by shooting was true however the two other killings and the Villa in Mexico they deemed untrue.

The stage was now set for the State of California to set up arrest and convict Colin Anditon using Michael Standon a convicted criminal wired and place in a cell for three days with Colin. Standon was instructed by Pomona Ploice Department to elicit the bragging stories from Colin to be audio and video taped. As a result of this incident Colin was charged with 1st degree murder, attempted murder and theft of leather jackets.

Truth lies and fantasy where do the begin and where do they end. The jury found Colin NOT GUILTY of use of a weapon (firearm), NOT GUILTY of possession of a firearm, NOT GUILTY of inflicting personal injury, GUILTY of first degree murder, GUILTY of attempted murder, GUILTY of stealing leather jackets.

No factual evidence was ever used to convict Colin Anditon. He was sentenced to 25 years to life on each charge and 8 years for the theft of jackets. Convicted only by his own jail house bravado half truth half fantasy to informant Michael Standon. To date no one else has ever been arrested or charged with the murder of Danny Hurtado or the attempted murder of Amondo Ortiz.

After seven years and $11,000.00 all of Colins US Federal appeals have been denied on technicalities i.e. Brief pages (submitted by an attourney) too long. Not exhausted state remedies and ordered to return to the State Supreme Court ( and finally time barred).

The merits of this case have yet to be heard. Colin now stands alone appealing to the US ninth Circuit Court of Appeal to hear his case and give him his day in court.
